Terms of Service — Ripeto

1. Introduction 

These Terms of Service ("Terms") govern your use of the Ripeto mobile application ("App") provided by Daynight Promotion d.o.o., Ul. Otona Župančića 6, 10000 Zagreb, Croatia, Company ID (OIB): 24996612885 ("we", "our", or "Provider").

By downloading, installing, or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree with these Terms, please do not use the App.

2. Description of Service

Ripeto is an educational application designed to help users prepare for exams through quizzes, spaced review of study material, and progress tracking. The App may include, but is not limited to:

• quizzes and questions organized by subjects and lessons

• learning progress tracking

• challenges and exam simulations

• flash cards and other review formats

• third-party educational content available within the App

Ripeto is not a substitute for formal education. Daynight Promotion d.o.o. is not affiliated with the Ministry of Education of the Republic of Croatia or any university or educational institution.

3. Registration and User Account

To use certain features of the App, you may need to create a user account. In doing so, you agree to:

• provide accurate and complete information

• keep your login credentials confidential

• notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if we determine a violation of these Terms.

4. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App on your personal mobile device, solely for personal and non-commercial use.

You may not:

• copy, modify, distribute, or sell the App or its content

• attempt to access the App's source code (reverse engineering)

• use the App for any unlawful purpose

• share your user account with others

• automatically collect data from the App (scraping, bots, etc.)

5. Purchases and Payment

5.1 Access Model

Access to certain content within the App may require a one-time purchase of time-limited access. Available access durations are displayed within the App at the time of purchase. Once the purchased period expires, access to the corresponding content will end. There is no automatic renewal or automatic billing. If you wish to continue using the content, a new purchase is required.

5.2 Payment Processing

All payments are processed through the Apple App Store or Google Play Store, depending on your device. Billing and refunds are subject to the terms of the respective platform (Apple or Google).

5.3 Refunds

Refund requests must be directed to Apple or Google through their official refund procedures. Daynight Promotion d.o.o. does not process refunds directly.

5.4 Price Changes

We reserve the right to change prices. Price changes do not affect previously purchased access periods.

6. Content 

6.1 Our Content

All content in the App, including questions, answers, explanations, graphics, logos, and software, is the property of Daynight Promotion d.o.o. or our partners and is protected by copyright and other intellectual property laws.

6.2 Third-Party Content

The App may contain educational content created or provided by third-party partners. Such content may be subject to additional terms of use set by those partners.

6.3 Content Accuracy

We make reasonable efforts to ensure that the content in the App is accurate and up to date, but we do not guarantee complete accuracy, completeness, or suitability of the content for any specific purpose. The App's content is provided for informational and educational purposes only.

7. Privacy and Data Protection

The collection and processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the App, you consent to the collection and processing of data in accordance with the Privacy Policy.

8. Notifications

The App may send you push notifications and in-app notifications related to your learning progress, study reminders, new content, and other relevant information. You can manage notification settings through your device settings or within the App itself.

9. App Updates

We may periodically release App updates that may include bug fixes, new features, or security improvements. Certain versions of the App may require a mandatory update to continue using the service. We recommend that you always use the latest version of the App.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without any warranties, express or implied.

• We do not guarantee that the App will be available without interruptions, errors, or security vulnerabilities.

• We are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the App.

• We are not responsible for exam results, grades, or any academic outcomes. Ripeto is a supplementary learning tool, not a guarantee of success.

11. Indemnification

 You agree to indemnify and hold harmless Daynight Promotion d.o.o., its directors, employees, and partners from all claims, losses, damages, and costs (including reasonable legal fees) arising from your breach of these Terms or unlawful use of the App.

12. Age Restrictions

The App is intended for individuals aged 13 and older. If you are under 18, your use of the App requires the consent of your parent or legal guardian. If we learn that an account has been created by a person under 13 without parental consent, we reserve the right to remove that account.

13. Termination

You may stop using the App at any time by deleting your user account or uninstalling the App. We reserve the right to suspend or terminate your access to the App in case of a breach of these Terms, without prior notice.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or email. Continued use of the App after changes are published constitutes acceptance of the new Terms. If you do not agree with the changes, your sole remedy is to stop using the App.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising from or related to these Terms shall be subject to the jurisdiction of the competent court in Zagreb, Republic of Croatia.

16. Severability 

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Daynight Promotion d.o.o. regarding the use of the App and supersede all prior oral or written agreements.
